It is of the length of 16 feet 8 inches and in height eleven feet - the eastern end and the Southeastern Corner are built on the rocK which rises within two feet of the roof or Stonern arch which covers it: it appears to have had two doors near the South western and north- eastern corners of the height of five feet and width of two feet without the least appearance of a window though probably there was one at the western end but demolished with the gable; and in the inside of the eastern end were two bolles or Cupboards. The Hermitage chapel which is situated twenty seven feet eastward from the cell and dedicated to St. Anthony is in length 43 1/2 feet in breadth 18 and the same in height. At the western end is a tower of 19 feet square but of what height at first I cannot ascertain though by the form of what is Standing I taKe it to have been about 40 feet. OS1/11/107/11 SANCTUARY OF HOLYROODHOUSE (For Debtors) Sanctuary of Holyroodhouse Sanctuary of Holyroodhouse Sanctuary of Holyroodhouse John Rogers Esqr. Bailie of Holyroodhouse HalKerston's History of Holyroodhouse Commission from the DuKe of Hamilton [Situation] In the Queen's Park. The district or tract of land which retains the privilege of a Sanctuary for debtors Consists of the precincts of Holyrood Palace including The Queen's ParK which was first enclosed by James V. to the extent of about 3 miles The right of Santuary of this place was originally a privilege invested in the Abbey of Holy Rood and extended it appears to all criminals who availed themselves of its privileges untill a fair trial was afforded them, In after times when it became exclusively the residence of the Kings the privlege of a Sanctuary for debtors was established which it has since retained. At present there are 15 persons availing themselves of the privilege, but the average number for a few years past is about twelve Formerly the average number was very considerable, the decrease of which is owing to the late changes in the law relating to Debtors and Creditors. The affairs of the Santuary are managed the same as that of a Burgh of Barony the DuKe of Hamilton being the Superior, Within the district is [a] court house where the Bailie who is appointed by the DuKe of Hamilton holds his court for the trial of civil cases of those within his jurisdiction There are also persons appointed who act as constables. The boundary was perambulated by Captn. [Captain] James R.E. [Royal Engineers] assisted by Lce Corpl. [Lance Corporal] Downing R.S. & M [Royal Sappers & Miners] [continued on page 12]

OS1/11/107/12 SANCTUARY OF HOLYROODHOUSE (For Debtors) [continued from page 11] The boundary was shewn by the Bailie and Constables of the Santuary "The Abbey Church & Palace which is surrounded with a precinct or liberty at present used as an asylum for insolvent debtors was antiently the sanctuary belonging to the monastery for the refuge and protection of criminals". Maitlands Hist. [History] of Edinb. [Edinburgh] page 153 "The precincts of this abbey and the Kings ParK first enclosed by James V. still retain the ancient previlege of being a Sanctuary for insolvent debtors. The Bailie of Holyrood is appointed by Commission from the DuKe of Hamilton and the protection of Sanctuary is obtained is obtained by petition to this functionary and the payment of £2.2.0 in name of fees The average annual number who avail themselves of this privilege for the ten years previous to 1834 was 55. The boundaries Comprise the Kings Park Salisbury Crags and the greater part of Arthur's Seat." Stat. Acct. [Statistical Account] of Edinburgh P. [Page] 662 "The precincts of the palace including the ground which was first inclosed by James V. to the extent of about 3 miles afford a sanctuary for debtors. This it would appear has the same boundary with the ancient Sanctuary belonging the monastery for the refuge and protection of criminals. This privilege is parhaps founded on the following clause in Davids Charter. I strictly forbid all persons from taKing a poind or making Seizure in or upon the lands of the said Holy Cross unless the Abbot refuse to do justice to the person injured The person who fled to the Abbey was thus secure if the abbot chose to protect him for what temporal judge would dare to accuse the holy Abbot of injustice. Expressive of the modern indemnity one who finds it necessary to take the benefit of the Girth afforded by the invirons of Holyrood-house is ludicrously termed an abbey Laird" Fullartons Gazetteer of Scotland
